wpd to file constitutional complaint against Windpower-At-Sea-Act

Bremen (renewablepress) - The Bremen-based project developer wpd has today filed a constitutional complaint with the Federal Constitutional Court in Karlsruhe against the provisions of the Windpower-At-Sea-Act which are excluding the wpd offshore project Kaikas from future tenders without compensation.

The Kaikas project, situated in the German North Sea, has been approved in 2013 with 80 wind turbine generators, however, it cannot be implemented at the moment since it is the only approved project which will be excluded from future tenders by the Windpower-At-Sea-Act, which came into effect on January 1, 2017. Prof. Dr. Marcus Dannecker, from the law firm of Gleiss Lutz, drafted a 150 page constitutional complaint which sees this as a violation of the principle of equality (Art. 3 of the German Constitution), of occupational freedom and of the right of ownership (Art. 12 and 14 of the German Constitution).

“For years, we have put faith in the legal situation which has urged developers – with a number of incentives – to develop projects. To meet the statutory requirements we have invested a two-digit million amount, just to lose all possibilities for the realization of the project through a change in the system shortly before implementation. There is no worse way to deal with investors and there is no way to more clearly undermine investment reliability”, comments Achim Berge Olsen, managing director of wpd offshore GmbH.
